Minute Med Notes and its related services, products, software, and content (the "Services" or the "Website") are owned and operated by Minute Med Notes LLC ("Minute Med Notes," "our," "us," "we"), a Texas limited liability company with its principal place of business in Houston, Texas. Minute Med Notes has adopted this Privacy Policy ("Privacy Policy") to inform you that it collects Personal Information when you use the Services and to explain how this information is used. This Privacy Policy applies to all online interactions with Minute Med Notes owned or managed websites and services and does not cover our offline data practices. Your personal information is not shared with unrelated third-party businesses except as expressly set forth in this Privacy Policy. IN THE EVENT MINUTE MED NOTES CHANGES, MODIFIES, AMENDS, OR REPLACES THIS PRIVACY POLICY, THE EFFECTIVE DATE, LOCATED ABOVE, WILL CHANGE. YOUR CONTINUED USE OF THE SERVICES AFTER A CHANGE IN THE EFFECTIVE DATE OF THIS PRIVACY POLICY CONSTITUTES YOUR MANIFESTATION OF ASSENT TO THE CHANGE, MODIFICATION, AMENDMENT, OR REPLACEMENT CONTAINED WITHIN. Definitions. 

  • California Consumer Privacy Act ("CCPA") means the California statute, as amended by the California Privacy Rights Act of 2020 ("CPRA"), intended to enhance privacy rights and consumer protection for residents of California, United States. 

  • General Data Protection Regulation ("GDPR") means European Union Regulation 2016/679 on data protection and privacy applicable to individuals within the European Economic Area ("EEA"). 

  • Personal Data under the GDPR means any information relating to an identified or identifiable natural person. An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person. 

  • Personal Information under the CCPA means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. For purposes of this Privacy Policy, "Personal Data" is included within this definition. 

  • Registered User(s) means Users who have created an Account with the Services. 

  • Account means a Registered User's account with the Services. 

  • User(s) means individuals who visit and browse the Website. 

  • You/Your means User(s). 

 

Types of Personal Information We Collect. 

Minute Med Notes collects the following Personal Information from all Users who contact Minute Med Notes seeking more information and use the Services: 

  • First name; 

  • Last name; 

  • Email address; 

  • Phone number; 

  • Billing address and shipping address; 

  • Any other information that you upload or submit to the Website directly or indirectly. 

 

Minute Med Notes collects the following Personal Information from all Registered Users who create an Account with the Services or purchase products through the Services:

  • Phone number; 

  • Billing address and shipping address; 

  • Transaction information, including the items you view, place in your cart, or purchase, return, exchange, or cancel, and your transaction history; 

  • Payment confirmation and other payment details (note: full payment card information is processed directly by our third-party payment processor, see "Payment Data" section below); 

  • Any other information that you upload or submit to the Services directly or indirectly. 

 

In addition, Minute Med Notes collects the following Personal Information from all Users automatically: 

  • Your approximate geolocation; 

  • Your IP address; 

  • Your browser and search engine information; 

  • Your device information, including device type, model, operating system version, and unique device identifiers; 

  • Your visitor history; 

  • Your usage of the Services, including, without limitation, any links or items clicked, pages viewed, and statistics; 

  • Information stored in cookies, pixel tags, web beacons, and similar tracking technologies; 

  • Analytical data from Google Analytics and related Google services; 

  • Any other additional analytic data that you voluntarily submit to the Services. 

 

Sources of Personal Information Collection. 

Minute Med Notes may collect this Personal Information from you through various channels, including, but not limited to, through your voluntary submission of information to the Services, through requests initiated by you through the Services, through the collection and analysis of information concerning your computer and browsing activities, through the use of cookies, web beacons, pixel tags, Google Analytics, and through third-party service providers such as Shopify, Inc., our e-commerce platform provider, and advertising and analytics partners. Minute Med Notes may also receive Personal Information about you from business partners, advertising networks, and other third parties as permitted by applicable law. 

Cookies & Similar Technologies. 

The Services also utilize Cookies. Cookies are small text files placed on your device to store data that can be recalled by a web server in the domain that placed the Cookie. We use Cookies and similar technologies, including pixel tags, web beacons, mobile advertising identifiers, and similar tracking technologies ("Tracking Technologies"), to enable our systems to recognize your browser, deliver certain features, analyze usage, and support advertising and analytics functions. We also use "web beacons" to help deliver Cookies and gather usage and performance data. The Services may also include Cookies, web beacons, pixel tags, and other similar Tracking Technologies from third-party service providers, including Shopify, Google, Meta (Facebook), and TikTok. 

 

You have a variety of tools available to control the data collected by Cookies, web beacons, and similar technologies. For example, you can use controls in your Internet browser to limit how the websites you visit are able to use Cookies and to withdraw your consent by clearing or blocking Cookies. We may also use the Meta (Facebook) Pixel to provide targeted advertisements to users who have previously interacted with our Services on Facebook and Instagram. We may additionally use the TikTok Pixel to provide targeted advertising on TikTok. Social media buttons (including Facebook, Instagram, and TikTok) may also place cookies when you interact with them on the Services.

Lawful Basis for Processing Your Personal Information. 

The lawful basis for us processing your Personal Information for the uses described in this Privacy Policy will typically be because: you have provided your consent; the processing is necessary for our contractual relationship with you (including fulfilling your orders and operating your Account); the processing is required for us to comply with our legal obligations; and/or the processing is in our legitimate interests of providing the Services, operating and improving our e-commerce platform, fulfilling orders for our educational products, and providing targeted offerings to our users. 

How Minute Med Notes Uses Your Personal Information. 

We use your Personal Information based upon the legal basis of Users' consent to provide you with the Services, process any requests made by you, communicate with you, identify and fix problems with the Services, and update you regarding changes to the Services and the Minute Med Notes and third-party services offered through the Services. 

 

By using the Services, you further authorize the following specific uses of your Personal Information:

  • Where sharing or disclosure of your Personal Information is necessary to provide you with the Services and/or associated services, including sharing with trusted third parties who assist us in operating the Website, processing orders, providing the associated services, and conducting our business; 

  • Where sharing or disclosure of your Personal Information is necessary pursuant to a campaign with Facebook, Instagram, TikTok, or other advertising platforms; 

  • Where sharing or disclosure of your Personal Information is necessary to share personal or personally identifiable information with Minute Med Notes's parents, subsidiaries, successors, assigns, licensees, affiliates, or business partners; 

  • Where Minute Med Notes has been purchased by a third party; 

  • Where sharing or disclosure of your Personal Information is necessary to respond to requests by government authorities; 

  • Where your Personal Information is demanded by a court order or subpoena; 

  • Where sharing or disclosure of your Personal Information is needed to protect the employees, independent contractors, officers, directors, members, users, or owners/shareholders of Minute Med Notes; 

  • Where sharing or disclosure of your Personal Information is needed to help prevent against fraud or the violation of any applicable law, statute, regulation, ordinance, or treaty; and 

  • Where Minute Med Notes is otherwise legally obligated to share your personal or personally identifiable information.

This list may not be exhaustive as to all the third parties Minute Med Notes may share your Personal Information with. Minute Med Notes is committed to keeping track of which third parties receive your Personal Information. 

Payment Data. 

Minute Med Notes does not directly store your full payment card information. Payments are processed by Shopify and its PCI DSS-compliant payment processing partners. Your payment information is shared with such processors solely for the purpose of completing your transaction. Please review Shopify's privacy policy at the time of purchase for information on how your payment data is handled. Minute Med Notes is not responsible for the data practices of payment processors. 

Relationship with Shopify. 

The Services are hosted by Shopify, Inc., which collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you reside, in order to provide and improve the Services for you. In addition, to help protect, grow, and improve our business, we use certain Shopify features that incorporate data and information obtained from your interactions with our store, along with other merchants and with Shopify. Shopify may make use of personal information collected about your interactions with our store, along with other merchants, and with Shopify, to provide these features. In these circumstances, Shopify is responsible for the processing of your personal information for such purposes, including for responding to your requests to exercise your rights over that information. No Liability Third-Party Services and Third-Party Links. 

The third-party service providers affiliated with Minute Med Notes have their own independent privacy policies governing the use of your Personal Information pursuant to the GDPR and CCPA and we encourage you to read those privacy policies carefully. You understand that even if Minute Med Notes deletes your Personal Information that it may still be available in a third-party service provider's database. Minute Med Notes has no responsibility or liability for the Personal Information collection, use, or storage activities of the third-party service providers used by Minute Med Notes to provide you with the services associated with the Services. 

 

Minute Med Notes may outsource or subcontract some of our technical support, tracking and reporting functions, database management functions, and other services to third parties. We may share information from or about you with them so that they can perform their services as long as they comply with this Privacy Policy, the GDPR, and the CCPA as applicable. You understand and agree that Minute Med Notes will not be held responsible for any third-party communications sent by entities that Minute Med Notes does not own or control. You are encouraged to review any third-party privacy policies before utilizing any such third-party service. 

 

Minute Med Notes may include or offer third-party products or services on the Services and provide third-party links to the same. These third-party websites have separate and independent privacy policies. Minute Med Notes has no responsibility or liability for the content and activities of such third parties or their websites. We encourage you to read carefully the privacy policies of all such third-party websites. 

Personal Information Transfer and Storage. 

Your Personal Information is stored and processed on computers and servers in the United States. Data protection laws vary among countries, with some providing more protection than others. Regardless of where your information is stored and processed, we apply the same protections described in this Privacy Policy. Through your use of the Services, you consent to the processing and storage of your Personal Information. You understand that your Personal Information may be transferred to, and maintained on, computers located outside of your state, province, country, or other governmental jurisdiction. If you are located outside the United States and choose to provide Personal Information to us, please note that we transfer your Personal Information to the United States and process it here. 

 

If we transfer your Personal Information out of the European Economic Area or the United Kingdom, we will rely on recognized transfer mechanisms like the European Commission's Standard Contractual Clauses, or any equivalent contracts issued by the relevant competent authority of the United Kingdom, as relevant, unless the data transfer is to a country that has been determined to provide an adequate level of protection. 

 

Minute Med Notes retains your Personal Information only for as long as necessary to fulfill the purposes described in this Privacy Policy. The criteria we use to determine retention periods include: (i) the duration of your Account and ongoing relationship with us; (ii) the period required to fulfill orders, process returns or exchanges, and resolve any related disputes; (iii) applicable legal, tax, accounting, or regulatory record-retention requirements (which generally range from three to seven years for transactional records); (iv) the period necessary to defend or assert legal claims; and (v) the sensitivity of the Personal Information and the risk of unauthorized use or disclosure. When Personal Information is no longer required for these purposes, we will securely delete or anonymize it. You may request deletion of your Personal Information as described herein. 

 

Minute Med Notes Users understand and agree that if they provide Minute Med Notes with Personal Information that it is stored until the User contacts Minute Med Notes to have their Personal Information removed from storage. As specified above, even if Minute Med Notes deletes your Personal Information from its own servers, it may still be available in a third-party service provider's database. You should consult with those third parties in the event you would like Personal Information deleted therefrom. 

Personal Information Security. 

Minute Med Notes implements reasonable administrative, technical, and organizational safeguards designed to protect your Personal Information from unauthorized access, use, disclosure, alteration, or destruction. These measures include, as appropriate, encryption of data in transit (using current Transport Layer Security (TLS) protocols, as indicated by the padlock icon and the https:// prefix in your browser) and encryption of data at rest, access controls, and regular security assessments. 

 

Though we undertake commercially reasonable efforts to protect your information, no website, software, or online service is completely safe. Accordingly, you provide all such information at your own risk. Minute Med Notes does not guarantee the absolute security of your Personal Information. If you believe your Account has been compromised, please contact us immediately at support@minutemednotes.com. 

No Users Under Age of 18. 

The Services are not intended for or directed to users under the age of 18. Minute Med Notes does not knowingly collect Personal Information from any individual under the age of 18, and in particular does not knowingly collect Personal Information from children under the age of 13 in violation of the Children's Online Privacy Protection Act (COPPA). Where appropriate, Minute Med Notes takes reasonable measures to determine that users are adults of legal age and to inform minors not to submit such information to the Services or in response to advertisements. If Minute Med Notes discovers that Personal Information has been collected from a minor under the age of 18, we will promptly deactivate the Account and delete all associated Personal Information from our records. If you are a parent or guardian and believe that a minor has provided Personal Information to Minute Med Notes without your consent, please contact us immediately at support@minutemednotes.com so we can take appropriate action. 

General Privacy Rights. 

Depending on your jurisdiction, you may have the following rights with respect to your Personal Information: 

  • Right of Access: You may have a right to obtain confirmation of whether we process your Personal Information, and to receive a copy of that information along with relevant details about our processing activities. 

  • Right to Correction / Rectification: You may have a right to request that we correct or complete inaccurate or incomplete Personal Information we maintain about you. 

  • Right of Erasure: You may have a right to request that we delete Personal Information we hold about you, subject to certain exceptions. 

  • Right to Restriction of Processing: You may have a right to request restriction of how and why your Personal Information is used or processed by us. 

  • Right to Data Portability: You may have a right to receive your Personal Information in a structured, machine-readable format and to have it transferred to another controller where technically feasible. 

  • Right to Object: You may have a right to object to our processing of your Personal Information for direct marketing purposes and for processing based on our legitimate interests. 

  • Right to Not Be Subject to Automated Decision-Making: You may have a right to not be subject to a decision based solely on automated processing, including profiling, that could have a legal or similarly significant effect on you. 

  • Right to Non-Discrimination: We will not discriminate against you for exercising any of your applicable privacy rights. 

 

EU/EEA Users' Rights Under the GDPR. 

The GDPR provides Users located in the European Economic Area (EEA) with certain rights with respect to their Personal Data collected by us. Minute Med Notes recognizes and will comply with the GDPR and those rights, except as limited by applicable law. The rights under the GDPR include: 

  • Right of Access (Art. 15): This includes the right to obtain from us your Personal Data and confirmation of whether it is being processed, along with the purposes of the processing; categories of Personal Data concerned; recipients to whom your Personal Data has been or will be disclosed; the period for which your Personal Data is being stored; your right to lodge a complaint; and the right to obtain a copy of your Personal Data. 

  • Right of Rectification (Art. 16): This includes the right to correct inaccurate Personal Data collected and/or stored by us, and to have incomplete Personal Data completed. 

  • Right of Erasure / Right to be Forgotten (Art. 17): This includes the right to have your Personal Data deleted. However, if applicable law requires us to comply with your request to delete information, fulfilment of your request may prevent you from using our services and may result in closing your account. 

  • Right to Restriction of Processing (Art. 18): This includes the right to request restriction of how and why your Personal Data is used or processed by us, including during the period in which we verify the accuracy of your Personal Data. 

  • Right to Data Portability (Art. 20): This includes the right to receive your Personal Data in a structured, commonly used, and machine-readable format and the right to have your Personal Data transmitted to another controller where technically feasible. 

  • Right to Object (Art. 21): This includes the right to object to us processing your Personal Data for reasons such as direct marketing purposes and for scientific or historical research or statistical purposes. 

  • Right to Not be Subject to Automated Decision-Making (Art. 22): This includes the right to not be subject to a decision based solely on automated processing, including profiling, that could have a legal or similarly significant effect on you. 

  • Right to Lodge a Complaint with a Supervisory Authority: You have the right to lodge a complaint with the data protection supervisory authority in the EEA member state of your habitual residence, place of work, or place of the alleged infringement. We would appreciate the chance to deal with your concerns before you approach the supervisory authority, and we invite you to contact us first. 

 

To exercise your rights under the GDPR, please contact Minute Med Notes at support@minutemednotes.com. Minute Med Notes will respond to verified requests within the timeframes required by applicable law, generally within one month of receipt, with the possibility of a two-month extension where permitted by law. 

EU/UK Representative. Minute Med Notes is established in the United States and currently does not meet the threshold criteria under GDPR Article 27 (or the equivalent UK GDPR provision) requiring the appointment of an EU or UK representative. If our processing activities change such that a representative is required, we will update this Privacy Policy with the representative's contact details. 

California Users' Rights (CCPA/CPRA). 

Under the CCPA, as amended by the CPRA, California Users have the following rights: 

  • Right to Know About Personal Information Collected, Disclosed, or Sold: You have the right to request that Minute Med Notes disclose what Personal Information of yours it collects, uses, discloses, and sells over the past 12 months, including the categories of Personal Information, the categories of sources, the business or commercial purpose for collecting or selling it, the categories of third parties with whom it is shared, and the specific pieces of Personal Information collected about you. 

  • Right to Request Deletion of Personal Information: You have the right to request that Minute Med Notes delete any of your Personal Information that we collected from you, subject to certain exceptions. 

  • Right to Correct Inaccurate Personal Information: You have the right to request that Minute Med Notes correct inaccurate Personal Information that we maintain about you. 

  • Right to Opt-Out of the Sale or Sharing of Personal Information: Minute Med Notes does not sell Personal Information for monetary consideration. However, our use of advertising pixels (such as Meta Pixel, TikTok Pixel, and Google advertising tools) may constitute "sharing" of Personal Information for cross-context behavioral advertising under the CPRA. You have the right to opt out of such sharing. To exercise this right, please contact us at support@minutemednotes.com. We also honor Global Privacy Control (GPC) opt-out signals from your browser. 

  • Right to Limit Use of Sensitive Personal Information: The CPRA grants California residents the right to limit the use and disclosure of "sensitive personal information" to uses necessary to perform the services requested. Minute Med Notes does not collect or process sensitive personal information (as defined under the CPRA) for purposes that would trigger this right. If our practices change, we will update this Privacy Policy and provide an opt-out mechanism. To exercise this right or inquire about our practices, please contact us at support@minutemednotes.com. 

  • Right to Non-Discrimination for Exercising CCPA Rights: Minute Med Notes shall not discriminate against California Users for exercising their rights under the CCPA. 

  • Shine the Light (California Civil Code § 1798.83): California residents may request once per year, free of charge, information about the categories of Personal Information we disclosed to third parties for their own direct marketing purposes in the preceding calendar year. To submit such a request, please contact us at support@minutemednotes.com. 

 

To exercise your rights under the CCPA/CPRA, or have an authorized agent exercise your rights on your behalf, please submit a request by contacting Minute Med Notes at support@minutemednotes.com. Minute Med Notes will verify this request by confirming that the request is associated with an email address or other identifier linked to your account or prior interaction with us. Minute Med Notes will respond to verified requests within 45 days of receipt, with the possibility of a 45-day extension where permitted by law. 

Supplemental Notice for Residents of Other U.S. States. 

Texas Data Privacy and Security Act (TDPSA) 

Texas residents have rights under the Texas Data Privacy and Security Act with respect to their personal data processed by Minute Med Notes, including the rights to confirm, access, correct, delete, and obtain a portable copy of their personal data, and to opt out of the processing of personal data for the purposes of targeted advertising, the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects. Minute Med Notes does not sell personal data. Texas residents may exercise their rights by contacting us as set forth herein. 

 

Florida Digital Bill of Rights (FDBR)

You may contact Minute Med Notes with any requests regarding your Personal Information. Because most modern browsers no longer support a uniform "Do Not Track" standard, Minute Med Notes does not separately respond to browser Do Not Track signals; however, Minute Med Notes honors Global Privacy Control (GPC) opt-out signals where technically feasible. Please note that deleting your Account may require deletion of certain information necessary to maintain account functionality. Even after deletion, some information may be retained in backup systems or third-party service provider databases, subject to their own retention policies.
